Who Is Eligible to Claim Compensation?

Who is eligible to claim compensation
Who is eligible to claim compensation

A motor vehicle collision can involve many different parties aside from the driver of the car. These parties may be able to claim injury compensation (and more) after being involved in a motor vehicle accident:

  • The driver of the vehicle
  • Passengers in the affected vehicles
  • Pedestrians
  • Cyclists
  • Family members/dependants of anyone involved in the accident

Is There a Timeframe to Claim Compensation?

Car accident compensation can only be claimed within strict time limits. This is why it’s essential that you contact a lawyer as soon as possible after the incident. We’ll ensure that your claims are still valid and get the claim process started right away.

In Queensland, you will need to submit your Notice of Accident Claim Form as soon as possible. We suggest that you submit this form within one month of the accident. In most cases, an injury or damages claim for compensation must be lodged by the claimant within nine months of the incident occurring. If you take longer than this, you might forfeit legal entitlements to compensation.

FAQs

If you’ve been injured in a car accident, certain claims are easily calculable. These include hospital bills, loss of income from missing work, and the like. Pain and suffering, on the other hand, account for non-calculable distress. This could include trauma, the overall impact on well-being, and potential future losses.

Pain and suffering payouts are calculated in accordance with the comparable “most extreme case” (MEC). These payouts work on a sliding scale and take into account factors like the claimant’s age, the severity of the injury, and how long of an impact it will have on the claimant’s life.

Pain and suffering is a complex calculation that will differ on a case-by-case basis. Per the Motor Accident Insurance Commission (MAIC), pain and suffering falls under “general damages” which are calculated by determining the Injury Scale Value (ISV). There are various intricate laws and regulations involved when calculating the ISVs, the final claim amount, and the claim process. This is why it’s important to hire an experienced compensation and car accident lawyer in Cairns to help you get the highest compensation possible.

Since every motor vehicle accident claim is different, it may take longer for some cases to be decided than others. Typically, a car accident case in Cairns takes anywhere between 9 and 18 months to be resolved.

In Queensland, all vehicles must be registered for third-party insurance. This type of insurance is there to compensate any third party involved in the car accident. According to Legal Aid Queensland, it is always the person who caused the accident, who is liable to pay compensation.

If you’re the driver and the owner of the car, the insurance mentioned above will pay compensation to other affected parties along with the damage caused to your vehicle.

Making a CTP claim from Cairns and Far North Queensland

A CTP claim runs under the same Queensland legislation whether the accident happened on the Bruce Highway south of Cairns or in Brisbane’s inner north. What changes in Far North Queensland is the practical side of the claim, and that is where being run locally matters.

What is different about a Far North Queensland claim

  • Medico-legal appointments. A CTP claim usually requires specialist examinations. Having the claim run from Cairns means those appointments are arranged around what is genuinely available in the region rather than assuming a trip to Brisbane.
  • Distance to the accident scene. Evidence gathering on the Captain Cook Highway, the Bruce Highway, the Kuranda Range and the rural roads of the Tablelands is not the same job as a suburban intersection collision, and CCTV is far less likely to exist.
  • Hire cars and visiting drivers. Far North Queensland has a high proportion of accidents involving interstate-registered and hire vehicles. Where the at-fault vehicle is registered outside Queensland, the claim is still made under the Queensland scheme but is lodged with and managed by that vehicle’s insurer in its home state, and the PDF claim form must be used.
  • Single-vehicle and animal-strike crashes. These are common on regional roads and often produce no CTP claim at all, because CTP responds to the fault of another driver. Serious injuries may still be covered by the no-fault National Injury Insurance Scheme Queensland.
  • Unregistered and unidentified vehicles. Regional hit-and-runs are harder to trace, which makes the Nominal Defendant route and its three-month deadline more relevant here than almost anywhere else in the state.

The deadlines do not move for distance

The Notice of Accident Claim Form is due by the earlier of nine months from the accident, or from when symptoms first appeared, or one month from your first meeting with a lawyer engaged to run the claim. Where the at-fault vehicle cannot be identified, that drops to three months. Living four hours from a major centre does not extend any of them. The full sequence is in our step-by-step guide to the Queensland CTP claim process.

For claims outside motor vehicle accidents, our Cairns compensation lawyers and Cairns personal injury lawyers pages cover workplace, public liability and WorkCover matters in the region.
